Default AR/AK Mags: Opinion from Maui Prosecutor

We had our HRS 134 class today. The Deputy Prosecutor who was instructing handles all the firearms cases for Maui County. Some points that I discussed with her...

Regarding 134-51 (no concealed deadly weapons) Concealed may be argued to mean that you cannot readily discern what the item is, like a pocket knife clipped in your pocket.... BUT a knife (or other potentially deadly item) that serves another primary purpose such as hunting, diving, (insert your own justfication), etc. is not considered a deadly weapon unless employed as such. The main point was that the weapons of concern were those used to commit a crime.

Regarding AR/AK mags... I specifically asked, "...what is the prosecutor's stance on 30 round AR15 and AK mags, being that these firearms are available in pistol configuration outside the state and that the mags are readily available in shops?"

Her answer was, "Technically, if you want to follow the letter of the law, they are illegal, BUT unless the magazine is discovered actually being used in an assault pistol, I would decline to prosecute, AND I don't believe that officers should be going after those guys (we were also discussing how everyone has them on the range) anyway."

She basically said that unless you have an AR/AK pistol, you don't have to worry about the mags. Of course an officer could still arrest you if he really wanted too, but I guess it would not go much further than that.

Also... regarding electric guns (tasers), she ventured that the law, as written, may be argued to allow tasers that do not fire probes (drive stun only) as it specifies the use of "missles".

On another note... the range here leaves much to be desired.
